1. Introduction
The App system is operated by Appway Park Ltd. ( “we “, us “ and “Appway”).
The terms & conditions will apply to anyone who uses our App & website (“you” or “user” and “Space Owner” ).
When you purchase your parking space through Appway mobile payment service, you will have agreed to have accepted these Terms and Conditions and you agree that your use of the Appway mobile payment service is subject to the following Terms and Conditions. If you do not agree with the Terms and Conditions in its entirety, please do not use any Appway mobile payment services. These Terms and Conditions may be modified at any time.
BY USING OUR SYSTEM YOU ACCEPT THESE TERMS AND AND CONDITIONS AND AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE GENERAL MOBILE PARKING & WEBSITE TERMS AND CONDITIONS.
2. We may make changes to these terms and conditions
We amend these terms from time to time. Each time you use our site, please check these terms to ensure you understand the terms that apply at the given time for any changes.
3. Offering our Services
We offer app-based systems that enable you to pay parking fees or register free parking hours according to the parking rules quickly and efficiently, along with access to other parking-related services. Our parking payment solutions allow you to pay for designated parking locations without the need for cash or traditional meters.
The website and App at the web address Appwaypark.com is a parking space rental organization which allows you to book parking spaces anywhere in Canada. We do not have control over nor are we responsible for the Parking Providers. We simply facilitate the payment for your use of the rental Parking Space.
4. User Registration
a. By clicking verify Mobile Number you will be bound by these terms and conditions in full and you also agree to be bound by the terms of your Privacy policy which explains the authorized use of personal information.
b. The site is operated by Appway Park. The mobile payment and membership is open to anyone who chooses to register within the site and agrees to provide some basic personal information.
You agree that all the information provided upon registration is correct, information submitted will be kept up to date at all times and to refrain from having more than one registration. We may use the information provided to us to contact you.
c. When you are registering through the App, your account will be created by signing in via Mobile Number . It is your responsibility to keep your account information safe and up to date and to refrain from sharing this information with other persons.
d. You may not have more than one registration at a time and we reserve the right to delete or cancel the membership of any person who has more than one registration at any given time.
e. You should inform us if you believe there has been unauthorized use of your account or if your phone or card is missing. We will not be liable for others using your account or card details. The User should not restrict any other user from properly using the Company App system information including limitation: obstructing the functionality of the Company Applications. Computer hacking or use of other intelligent agent software or device to access or monitor the Company Applications.
We also reserve the right to terminate your registration immediately without notice if in breach of these terms and conditions.
f. You should not use the site to publish any fraudulent, misleading, offensive or any other illegal information and will not do anything which may disrupt, damage or impair the Service.
The User will not utilize the Company Applications in a manner that is harmful to the Company or any other person or entity.
g. The User should not download any of the Company Applications and agrees not to reproduce, copy, sell or duplicate any Company Applications for any purpose.
User will not provide or make available the App in whole or in part including any object and source code in any form to any person without prior written consent from us.
h. The site may include links to other web sites or material which are beyond its control. We are not responsible for content on any outside site.
Our parking payment systems may be used in combination of services offered by our partners in the same location that we offer services. Our partners will have their own policy and terms of services and you will be required to accept their terms or services before use. We will not be responsible for the services offered by our partners and you will abide by all parking signs rules and regulations.
i. The user should read signs posted at the entrance and throughout the property carefully to ensure parking is in an assigned/designated space.
5. Safety of your vehicle
The parking lot is open to the general public and we are not responsible for your vehicle or its contents. Please remove all valuables and lock all windows/doors securely. We suggest that no items be left in the vehicle and are not visible from the outside.
6. Limitation of Liability
a. Appway will not be liable for any lost profits, loss of data, or costs of procurement of substitute goods or services or for any claim or demand against you by any other party.
b. Appway will not be liable for any special, consequential or indirect damages whatsoever arising out of:
mistakes, errors, or inaccuracies on the Website or the App or related services. This includes personal injury or property damage, or any nature whatsoever resulting from your access to the use of the App & Website or Services or any booking with Owner or Driver.
We reserve the right to restrict access or suspend access to the site for the allowance of maintenance or repairs. In this event, we will make every effort to restore access to the parking site as quickly and as reasonably as possible.
7. The availability of the system and Parking Spaces
You acknowledge that our parking payment systems are dependent on the operation of your mobile device, the internet and other resources that you use to access our services. If you park in the case for which you don’t have access to the App, you must ensure that you are allowed to park there, otherwise you may be liable to additional parking fees, parking ticket fees and/or towing charges.
We also cannot guarantee availability of Parking Spaces or other services provided by Parking Providers or third parties during Parking Sessions.

8. Payment & Cancellation
Any time you use the System to pay for a Parking Spot, your Parking Session will be confirmed in the App and will begin at the point payment is successfully processed.
You will be charged the amount shown on the App screen prior to the start of your parking session, and your payment will be processed by our trusted payment partners.
All parking payments are final and non-refundable. Refunds will not be issued for user errors, including but not limited to selecting the incorrect location, entering an incorrect license plate number, failing to properly register, exceeding permitted time, or leaving the property earlier than intended.
Refunds will only be considered in the event of a verified system error or if the space owner cancels the booking. In such cases, the user will receive a full refund.
For monthly or long-term parking arrangements, cancellations must be made at least twenty (20) days prior to the start of the next billing cycle to qualify for a refund.
9. Space Owner
You authorize us to advertise your parking space on the Website and the App and provide information to Drivers who may wish to use the parking space. This includes promotional materials to Drivers and information about your parking.
As the space owner you agree to provide all relevant information about your parking space including but not limited to:
Name, contact number, email, type of parking, any restrictions, space availability, account, key, pincode etc. and also provide us with any other relevant information relating to you or the parking space.
Ensure before any booking that the parking space is well kept and in safe condition and is able to meet the requirements of the user under the booking agreement.
You may be liable for inaccurate, incomplete or misleading information provided by you and you may be ordered to pay reasonable damages on the basis of misrepresentation, breach of contract or otherwise.
We may remove your listing and/or account if the Parking Space does not conform to the information you have provided or does not meet our standards set out.
The User and space owner agree not to disclose any confidential information of one another. Confidential information includes information of a confidential nature which is obtained during the course of their contractual relationship or as a result of the use of the Parking Space and which is not publically available information.
10. Parking Rules, Registration & Enforcement
By parking on any property managed through the Appway system or by using the registration system, you are entering into a binding agreement and agree to comply with all posted signage, property-specific rules, and the following conditions:
a. Visitor Registration Requirement
All visitors must register their vehicle using the QR code system (where applicable) prior to parking. Failure to properly register a vehicle may result in parking violation notices, additional fees, and/or towing.
b. Compliance with Property Rules
Parking is subject to the specific rules and restrictions of each property, including but not limited to time limits, designated parking areas, and permitted usage. Users must review and comply with all posted signage on-site.
c. Time Restrictions
Visitor parking may be limited in duration per visit, per day, or as defined by property rules. Vehicles exceeding the permitted time may be subject to enforcement action.
d. Active Registration Limits
Certain properties may limit the number of active visitor registrations per unit (e.g., a maximum number of vehicles permitted at any one time). Users must comply with these limits where applicable.
e. Resident Restrictions
Residents are not permitted to use visitor parking stalls unless explicitly authorized by the property. Misuse of visitor parking is considered a violation.
f. Code Usage and Responsibility
Any registration code assigned to a unit must be kept confidential and used only by authorized individuals. The unit holder is fully responsible for all vehicle registrations made using their code.
g. Misuse and Suspension
In cases of misuse, abuse, or repeated violations (including but not limited to unauthorized registrations, sharing of codes, or exceeding permitted limits), access to the registration system may be suspended or deactivated without notice until all outstanding violations are resolved.
h. Enforcement Measures
Vehicles in violation of posted rules or these Terms & Conditions may be issued parking violation notices, additional charges, and/or removed (towed) at the vehicle owner’s risk and expense.
i. Prohibited Parking Areas
Parking is strictly prohibited in fire lanes, roadways, loading zones, or any areas marked “No Parking” or “Restricted.” Immediate enforcement action may be taken.
j. Agreement to Terms and Signage
By parking on the property or using the registration system, users acknowledge and agree that all posted signage and property rules form part of these Terms & Conditions and are legally binding.
k. System Use Responsibility
Failure to access, use, or correctly complete the registration process does not exempt the user from complying with parking rules. Users remain responsible for ensuring their vehicle is properly registered and authorized at all times.
l. No Guarantee of Parking Space
Registration or payment does not guarantee the availability of a parking space. Users must park only in permitted and designated areas.
m. Outstanding Fees and Recovery
Unpaid parking violation notices may be subject to additional administrative fees and collection or recovery actions in accordance with applicable laws.
